Premium Processing for EB-1 and EB-2 Form I-140 Petitions, together with Future Expansion for F-1 Students Seeking OPT, and Certain Student and Exchange Visitors

U.S. Citizenship and Immigration Services (USCIS) is entering the final phase of the premium processing expansion for Form I-140, Immigrant Petition for Alien Workers, under the EB-1 and EB-2 classifications.

This phase, unlike previous phases of the expansion, applies to new (initial) petitions as well as all previously filed Form I-140 petitions seeking a national interest waiver under an E13 multinational executive and manager classification or E21 classification as a member of professions with advanced degrees or exceptional ability (NIW).

Petitioners who want premium processing must submit the Form I-1907, Request for Premium Processing Service.

What Is The Purpose Of The Form 1907?

Form I-907 is used to seek Premium Processing Service for petitions or applications when Premium Processing Service is offered.

The Premium Processing Service request can be filed after you have filed the appropriate petition or application, as long as USCIS has not reached a final decision on the related petition or application. You cannot seek Premium Processing Service for a petition or application that has been reopened after an initial decision has been reached on the petition or application.

As of January 30, 2023, the USCIS began accepting Form I-1907 petitions for:

  • All E13 multinational executive and management petitions
  • E21 NIW petitions that are currently outstanding
  • Initial E13 multinational executive and manager petitions, as well as E21 NIW petitions.

Please take note: Starting May 31, 2022, you must pay the Form I-907 fee separately from other filing fees. If you submit a single, combined fee payment for multiple forms, we will reject the forms for improper fee payment.

According to a prior release by the USCIS, they are expanding premium processing to more form types as part of our efforts to boost efficiency and minimize burdens on the entire legal immigration system.

The USCIS will expand premium processing to some F-1 students seeking Optional Practical Training (OPT) and STEM OPT extensions who have a pending Form I-765, Application for Employment Authorization, in March. They will begin to offer premium processing to F-1 students seeking OPT and STEM OPT extensions who file an initial Form I-765 in April.

As the USCIS expands premium processing in a progressive approach, they are continuing to work toward the availability of premium processing for Form I-539, Application to Extend/Change Nonimmigrant Status.

The USCIS anticipates an increase in premium processing for certain student and exchange visitors who have outstanding Form I-539 applications in May, as well as certain student and exchange visitors who file initial Form I-539 applications in June. They will also ensure that the expansion of premium processing does not result in an increase in processing times for immigration benefit requests that are not marked for premium processing or an increase in normal processing of immigration benefit requests that are so designated.
